PIERRE (AP) -- Attorney General Marty Jackley says South Dakota will get about $1.3 million as part of a settlement between the U.S. government and Abbott Laboratories related to the anti-seizure drug Depakote.
The company has pleaded guilty and agreed to pay $1.5 billion over allegations that it promoted the drug for uses that were not approved by the Food and Drug Administration.
The case includes a criminal fine and forfeiture of $700 million and civil settlements with the federal government and states totaling $800 million.
Jackley says about $443,000 of South Dakota's share will go back to the state's general fund and $857,000 is the federal share. He says the settlement puts a stop to an improper pharmaceutical company marketing practice that needlessly wasted taxpayer dollars.
