SD court upholds perjury conviction

PIERRE (AP) -- The South Dakota Supreme Court has upheld a man's perjury conviction for testimony he gave when a jury in an earlier trial acquitted him of grand theft.

Thursday's decision marks the third time the high court has ruled on different issues in Trent Danielson's case.

Danielson was originally charged with stealing parts and checks while working for Rocket Lube of Spearfish, but a jury acquitted him in 2008. Danielson was then indicted for perjury for allegedly lying when he testified he had replaced transmission parts on a customer's 1950 Studebaker.

A jury last year found Danielson guilty of perjury, and a judge gave him a suspended sentence and put him on probation for three years.

The Supreme Court ruled Thursday that prosecutors presented sufficient evidence to support the perjury conviction.
