A Mitchell woman was arrested in late October for possession of a controlled substance after someone called in her erratic driving.

Marie Brinker, 33, was driving a 1998 Ford Contour and allegedly speeding through residential areas and at one point, in a school zone, according to court documents. Law enforcement caught up with Brinker at her residence. She was unsteady on her feet, could not keep her balance and was very nervous, court documents say.

Law enforcement asked Brinker if she had anything illegal, and she took out a baggie with marijuana in it, and another baggie containing pills.

The pills were hydrocodone, a controlled substance.

She failed field sobriety tests, but law enforcement determined she was under the influence of drugs, not alcohol. Law enforcement got a warrant for her urine to test for drugs, as Brinker refused a blood draw.

Possession of a controlled substance carries a maximum penalty of five years in prison and a $10,000 fine, upon conviction.

She is also charged with misdemeanors for possession of 2 ounces or less of marijuana, first-offense DUI and driving without a valid driver's license.
