A Mitchell man is facing felony charges for aggravated domestic assault and possession of a controlled substance earlier this month.
Daniel Box, 29, was charged with two felony charges, and a misdemeanor charge of possession of drug paraphernalia after allegedly a choking a woman.
According to court documents, Mitchell law enforcement was dispatched to 420 S. Duff St. on Oct. 5 for a welfare check. When officers arrived, Box was running from the house and a victim was yelling for help from the garage. A short foot pursuit ended when officers found Box in the backyard hiding in the bushes.
When Box was taken into custody, he continued grabbing at his pockets, and a search revealed a used syringe and a small baggie that field-tested positive for methamphetamine. Authorities said they interviewed the victim, who reported to a family member that she had been strangled by Box and law enforcement said she had hand prints around her neck consistent with being strangled. She said "she could not breathe and felt pressure on her airway when being strangled," according to a court affidavit.
Court documents say that Box had two outstanding warrants in Davison County at the time of his arrest and was on probation for a controlled substance.

If convicted, aggravated domestic assault carries the most severe maximum penalty as a Class 3 felony, up to 15 years in the state penitentiary and a fine of up to $30,000. Possession of a controlled substance is a Class 5 felony, with a maximum penalty of five years in the state penitentiary and a fine of up to $10,000.
