A 47-year-old Mitchell man was arrested recently and charged with raping a 15-year-old girl.
On Jan. 21, a 15-year-old female reported to police that she had non-consensual intercourse with Steven Nichols in her home. The juvenile claimed she was too afraid to say or do anything to stop the intercourse, according to court documents.
Nichols allegedly admitted to having intercourse with the girl and that she did not verbally consent, but he thought she had consented by her non-verbal cues.
Nichols was charged with fourth-degree rape, a Class 3 felony, punishable upon conviction by up to 15 years in prison and a $30,000 fine.
