The following cases were among those heard Tuesday during a circuit court session at the Davison County Public Safety Center, with Judge Chris Giles presiding:
Brianna Maslack, 20, of Huron, pleaded guilty to possession of two ounces of marijuana or less, a Class 1 misdemeanor, as part of a plea agreement. She was sentenced to 60 days of jail suspended and will have to pay $623.70 in fines and court costs.
Vennessa Guevara, 28, of Mitchell, pleaded guilty to third-offense DUI, which is a Class 6 felony and carries a maximum penalty of two years in the penitentiary and a $4,000 fine. Sentencing is scheduled for Jan. 5, 2021.
Caleb Moore, 19, of Mitchell, pleaded not guilty to a number of charges he faces, including two counts of grand theft of more than $1,000 and less than $2,500, a Class 6 felony. His next hearing is scheduled for Jan. 19, 2021.
Lance Shields, 27, of Mitchell, had a bench warrant issued in his name after failing to appear in court. He faces two felony charges of intentional damage to property, a Class 6 felony. A jury trial is currently scheduled for Dec. 14.
Leah Littlehead, 38, of Mitchell, pleaded not guilty to a number of drug-related charges, including two counts of possession of a controlled substance (meth), which is a Class 5 felony. A jury trial is currently scheduled for Feb. 8, 2021.
Laura Haas, 34, of Sioux Falls, pleaded not guilty to a number of drug-related charges, including two counts of possession of a controlled substance (meth), which is a Class 5 felony. A jury trial is currently scheduled for Feb. 8, 2021.
Tramaine Moss, 34, of Parkland, Wash., received a suspended execution of sentence for possession of marijuana between 1/2 and 1 pound, a Class 5 felony. He received five years suspended in the state penitentiary, two years of probation, 10 days of jail time and must pay $636.90 in fines, court costs and fees.
Daniel Box, 29, of Mitchell, pleaded guilty to possession of a controlled substance (meth), a Class 5 felony. He was sentenced to five years suspended in the state penitentiary to run consecutive to a 2018 sentence, with credit for 50 days time served and must pay $206.90 in fines, court costs and fees.
Paige Provancial, 34, of Mitchell, pleaded guilty to one court of possession of a controlled substance (meth), a Class 5 felony. She faces a Class 5 felony that carries a maximum penalty of five years in the state penitentiary and/or a $10,000 fine. Sentencing was scheduled for Jan. 19, 2021.
Everardo Herrera Torres, 48, of Howard, pleaded guilty to third-offense DUI, a Class 6 felony that carries a maximum penalty of two years in the state penitentiary and/or a $4,000 fine. Sentencing is scheduled for Jan. 5, 2021.
Martin Morris, 61, of Mitchell, pleaded guilty to possession of a controlled substance, a Class 5 felony. He received a suspended execution of sentence for five years in the state penitentiary, with credit for 37 days served. He also received two years of probation and must pay $629.25 in fines, court costs and fees.
Daisy Hordeyczuk, 27, of Clearwater, Fla., pleaded guilty to possession of a controlled substance (heroin), a Class 5 felony. She was sentenced to five years suspended in the state penitentiary, with credit for two days time served and received two years of probation. She must pay $885.40 in fines, court costs and fees.
Robert Motley, 37, of Mitchell, pleaded guilty to possession of a controlled substance (meth), a Class 5 felony. He was sentenced to five years suspended in the state penitentiary, with credit for two days time served and received two years of probation. He must pay $1,187.30 in fines, court costs and fees.
David Rowland, 28, of Mitchell, pleaded guilty to simple assault that intentionally causes bodily injury to another person, a Class 1 misdemeanor. He was previously facing two felony charges for aggravated assault. He was sentenced to 90 days in jail, with 72 days suspended and credit for 18 days time served. He must pay $545.30 in fines, court costs and fees.
Ashley Haus, 19, of Collegeville, Pa., pleaded not guilty to a number of charges, including felony charges for possession of a controlled substance and possession of marijuana. A jury trial is scheduled for Feb. 8, 2021.
Gerald Littlehead, 38, of Mitchell, pleaded guilty to one count of possession of a controlled substance (meth). As part of a plea agreement, the remaining charges were dropped. He faces a Class 5 felony that carries a maximum penalty of five years in the state penitentiary and/or a $10,000 fine. A pre-sentence investigation was ordered. Sentencing is scheduled for Jan. 5, 2021.
James Motley, 39, of Harrisburg, pleaded guilty to one court of possession of a controlled substance (ecstasy). As part of a plea agreement, the remaining charges were dropped. He received five years suspended in the state penitentiary consecutive to a current Department of Corrections sentence, with 12 days credit time served and must pay $210.50 in fines, court costs and fees. He is scheduled to enroll in a treatment program in the coming weeks.
Wetu Kiyukan, 25, of Mitchell, pleaded guilty to one count of possession of a controlled substance. As part of a plea agreement, the remaining charges were dropped. She faces a Class 5 felony that carries a maximum penalty of five years in the state penitentiary and/or a $10,000 fine. Sentencing in the case is scheduled for Dec. 22.
Donevan Smith, 34, of Bremerton, Wash., pleaded guilty to one court of possession of a controlled substance, a Class 5 felony. He was sentenced to five years in the state penitentiary with suspended execution of sentence, two years probation, which can be lowered with good behavior. He is also subject to pay a $750 fine, plus court costs and court-appointed attorney fees.
