Felony court cases for April 28

The following cases were among those heard Tuesday during a circuit court session at the Davison County Public Safety Center.

  • Gage Schaub, 20, of Mitchell, failed to appear on charges of violating probation for two previous convictions of fourth-degree rape, a Class 3 felony which carries a maximum penalty of 15 years in the state penitentiary and a $30,000 fine; Court issued a no-bond bench warrant.
  • Lane Van Erdewyk, 21, of Mitchell, failed to appear on charges of grand theft of more than $1,000 and less than or equal to $2,500, a Class 6 felony which carries a maximum penalty of two years in the state penitentiary and a $4,000 fine; Court issued a no-bond bench warrant.
  • Justin Bublitz, 32, of Mitchell, was sentenced to five years in prison with four years suspended and credit for 22 days served for unauthorized ingestion of methamphetamine, a Class 5 felony which carries a maximum penalty of five years in the state penitentiary and a $10,000 fine; Must pay $269 in restitution and $106.50 in court costs; Must repay court-appointed attorney's fees.
  • Cleo Gravatt, 41, of Mitchell, admitted to violating probation for a previous conviction of possession of methamphetamine, a Class 5 felony; Sentenced to five years in prison suspended with credit for 128 days served and two years probation; Must repay all previously ordered amounts; Must repay court-appointed attorney's fees.
  • Neal Ferguson, 41, of Mitchell, was sentenced to two years in prison with credit for 20 days served for violating probation for a previous conviction of delivery of drug paraphernalia, a Class 6 felony which carries a maximum penalty of two years in the state penitentiary and a $4,000 fine.
  • Charles Wright, 39, of Mitchell, was sentenced to two sentences of five years in prison with credit for 102 days served and four years probation for two counts of possession of a controlled substance in schedules I or II, a Class 5 felony; Must repay all previously ordered amounts; Must repay court-appointed attorney's fees.
  • Steven Burning Breast, 24, of Mission, pleaded guilty to entering or refusing to leave a property after receiving notice, a Class 1 misdemeanor which carries a maximum penalty of one year in the county jail and a $2,000 fine; Sentenced to 96 days in jail with 90 days suspended and credit for six days served; Must pay a $500 fine, $250 in restitution and $86.50 in court costs; Must repay court-appointed attorney's fees.
