TRIPP -- A Tripp man was charged on July 29 for allegedly possessing and distributing images depicting child pornography on Tumblr.
David Derrico, 50, faces four counts of possession with intent to distribute child pornography.
According to court documents, a special agent with the South Dakota Division of Criminal Investigation received a CyberTip regarding two Tumblr accounts suspected of containing image files depicting child pornography. Both tips contained a small number of IP address connection logs that listed some of the addresses used to access the Tumblr accounts. The Tumblr accounts and email addresses appeared related to Derrico, a prior offender who is currently on parole.
The special agent allegedly received a search warrant for subscriber information regarding the four Santel Communications IP addresses listed in the CyberTips, user content on the Tumblr accounts and email addresses. The warrant showed that four IP addresses and IP addresses used to access the Tumblr accounts had been listed to his residence.
In one Tumblr account, the records production contained about 56 image files depicting child pornography that were publicly posted or shared through private messages, according to court documents. In the other Tumblr account, the records production contained one image depicting child pornography, with the majority of IP addresses connecting to his residence.
The search warrant of his email addresses allegedly showed subscriber information related to Derrico, including his first and last name and cell phone number. The IP address connection logs for both emails showed regular access at his residence.
According to court documents, during a search warrant of Derrico’s residence, he admitted to owning the Tumblr accounts and email addresses. He said he used the Tumblr accounts to exchange pornographic images, though did not remember sending or receiving any files depicting child pornography. During the interview, another agent found images depicting child pornography on a tablet.
The possession with intent to distribute child pornography is a Class 3 felony, punishable upon conviction by up to 15 years in prison and a $30,000 fine.
