The following cases were among those heard Tuesday during a circuit court session at the Davison County Public Safety Center.

  • Freddy Parra Zepeda, 24, of Corning, California, failed to appear on charges of possession of more than 10 pounds of marijuana and possession with intent to distribute one pound or more of marijuana, both of which are Class 3 felonies which carry a maximum penalty of 15 years in prison and a $30,000 fine; And possession of drug paraphernalia, a Class 2 misdemeanor which carries a maximum penalty of 30 days in the county jail and a $500 fine; Court issued a no-bond bench warrant.
  • Nikki Eveland, 25, of Chamberlain, pleaded not guilty to possession of hydrocodone with intent to distribute, a Class 4 felony which carries a maximum penalty of 10 years in prison and a $20,000 fine; Two counts of possession of hydrocodone, a Class 5 felony which carries a maximum penalty of five years in prison and a $10,000 fine; And two counts of possession of drug paraphernalia; Jury trial scheduled for Aug. 10.
  • Kelly Cruz, 40, of Bottineau, North Dakota, pleaded not guilty to possession of three or more schedule II related items, a Class 3 felony; Possession of heroin, possession of meth and possession of THC hash oil, all of which are Class 5 felonies; Possession of two ounces of marijuana or less, a Class 1 misdemeanor which carries a maximum penalty of one year in the county jail and a $2,000 fine; And possession of drug paraphernalia; Jury trial scheduled for Aug. 10.
  • Ruben Cruz, 37, of Bottineau, North Dakota, pleaded not guilty to possession of three or more schedule II related items, possession of heroin, possession of meth, possession of THC hash oil, possession of two ounces of marijuana or less and possession of drug paraphernalia; Jury trial scheduled for Aug. 10.
  • Rodney Hrdlicka, 54, of Kaylor, pleaded guilty to ingesting a substance other than alcohol for the purpose of intoxication, a Class 1 misdemeanor; Must pay a $500 fine, $86.50 in court costs and $70 in prosecution costs; Must repay court-appointed attorney's fees
  • Tod Bryan, 45, of Mitchell, pleaded guilty to possession of two ounces of marijuana or less, a Class 1 misdemeanor; Sentenced to 30 days in jail suspended; Must pay a $500 fine, $84 in court costs and $74.49 in prosecution costs; Must repay court-appointed attorney's fees.
  • Andrew Savage, 29, of Blacksburg, South Carolina, pleaded guilty to possession with intent to distribute one pound or more of marijuana and possession of hashish; Sentencing scheduled for July 7.
  • Cole Gustafson, 26, of Mitchell, pleaded guilty to possession of cocaine, a Class 5 felony; Sentencing scheduled for July 7.
  • Ryan Smith, 29, of Chamberlain, pleaded not guilty to possession of hydrocodone and possession of drug paraphernalia; Jury trial scheduled for Aug. 10.
  • Hayley Withhorn, 26, of Mitchell, pleaded not guilty to intentional property damage of more than $2,500 and less than $5,000, a Class 5 felony; Jury trial scheduled for Aug. 10.
  • Myron Kirkie Jr., 20, of Mitchell, pleaded guilty to misprision of a felony, a Class 1 misdemeanor; Sentenced to 64 days in jail with 60 days suspended and credit for four days served; Must pay a $500 fine, $86.50 in court costs and $13.60 in prosecution costs; Must repay court-appointed attorney's fees.
  • Melissa Hedger, 44, of Mitchell, pleaded guilty to possession of meth; Sentenced to five years in prison suspended with credit for 17 days served; Must complete James Valley Drug and DUI Court Program; Must pay a $500 fine and $106.50 in court costs; Admitted to violating probation for a previous conviction of cruelty to animals, a Class 6 felony which carries a maximum penalty of two years in prison and a $4,000 fine; Sentenced consecutively to two years suspended with credit for 39 days served; Admitted to violating probation for a previous conviction of possession of a controlled substance in schedules I or II; Sentenced consecutively to five years in prison suspended with credit for 25 days served; Must repay all previously ordered amounts; Must repay court-appointed attorney's fees.
  • Lexine Atwood, 43, of Mitchell, pleaded guilty to possession of meth; Sentenced to five years in prison suspended and three years probation; Must pay a $500 fine and $106.50 in court costs; Must repay court-appointed attorney's fees.
  • Sapphire Big Eagle Obago, 26, of Sioux Falls, pleaded guilty to possession of meth; Sentenced to five years in prison suspended and three years probation; Must pay $120 in prosecution costs and $106.50 in court costs; Must repay court-appointed attorney's fees.
  • Mahlon Bruguier Sr., 41, of Mitchell, pleaded guilty to possession of meth; Sentencing scheduled for June 23.
  • Mahl'i Shell, 18, of Mitchell, was granted a suspended imposition of sentence with credit for 76 days served and three years probation for intentional property damage of between $5,000 and $100,000, a Class 4 felony which carries a maximum penalty of 10 years in prison and a $20,000 fine; And aggravated criminal entry of a motor vehicle, a Class 6 felony; Must spend two days in jail every six months on probation; Must pay $9,133.42 in restitution jointly and severally; Must pay a $500 fine; Must pay $213 in court costs; Must repay court-appointed attorney's fees.
