The following cases were among those heard Tuesday during a circuit court session at the Davison County Public Safety Center.

  • Troy Hofer, 22, of Mitchell, pleaded guilty to a first-offense DUI, a Class 1 misdemeanor which carries a maximum penalty of one year in the county jail and a $2,000 fine; Court granted a suspended imposition of sentence; Must pay a $500 fine, $151 for a blood test, $86.50 in court costs and a $50 DUI surcharge.
  • John Bunker, 53, of Mitchell, failed to appear on charges of possession with intent to distribute one ounce or less of marijuana, a Class 6 felony which carries a maximum penalty of two years in the state penitentiary and a $4,000 fine; Possession of two ounces of marijuana or less, a Class 1 misdemeanor; And failure to maintain financial responsibility, a Class 2 misdemeanor which carries a maximum penalty of 30 days in the county jail and a $500 fine; Court issued a no-bond bench warrant.
  • Kaemon Dengler, 20, of Mitchell, pleaded not guilty to two counts of aiding and abetting grand theft of a firearm with a value less than or equal to $2,500, a Class 6 felony; And three counts of criminal entry of a motor vehicle, a Class 1 misdemeanor; Jury trial scheduled for June 29.
  • Jordan Olsen, 24, of Mitchell, pleaded guilty to a first-offense DUI; Court granted a suspended imposition of sentence; Sentenced to two days in jail; Must pay a $500 fine, $151 for a blood test, $86.50 in court costs and a $50 DUI surcharge.
  • Shafie Mohamed, 22, of Waite Park, Minnesota, pleaded guilty to possession of cathinone, a Class 5 felony which carries a maximum penalty of five years in the state penitentiary and a $10,000 fine; Court granted a suspended imposition of sentence; Sentenced to eight days in jail with credit for one day served and two years probation; Must pay a $1,000 fine, $161.90 in prosecution costs and $106.50 in court costs; Must repay court-appointed attorney's fees.
  • Joseph Davis, 28, of Mitchell, was sentenced to five years in prison suspended with credit for seven days served for possession of hash wax, a Class 5 felony; Must pay a $500 fine, $160.50 in prosecution costs and $106.50 in court costs; Must repay court-appointed attorney's fees.
  • Chelsey McKibben, 29, of Mitchell, admitted to violating probation for a previous conviction of possession of a controlled substance in schedules I or II; Sentenced to five years in prison suspended with credit for 14 days served and two years probation; Must repay all previously-ordered amounts; Pleaded guilty to possession of methamphetamine, a Class 5 felony; Sentenced concurrently to five years in prison suspended and two years probation; Must pay a $500 fine, $147.20 in prosecution costs and $106.50 in court costs; Must repay court-appointed attorney's fees.
  • Tarhea Rath, 27, of Mitchell, pleaded not guilty to unlawful use of a computer system, a Class 5 felony; 10 counts of identity theft, a Class 6 felony; and petty theft, a Class 2 misdemeanor; Jury trial scheduled for June 29.
  • Jennifer Thaler, 40, of Mitchell, pleaded not guilty to possession with intent to distribute one pound or more of marijuana, a Class 3 felony which carries a maximum penalty of 15 years in the state penitentiary and a $30,000 fine; Possession of between one and 10 pounds of marijuana and possession with intent to distribute delta-9 tetrahydrocannabinol, both of which are Class 4 felonies which carry a maximum penalty of 10 years in the state penitentiary and a $20,000 fine; And possession of delta-9 tetrahydrocannabinol, a Class 5 felony; Jury trial scheduled for June 29.
  • Corban Johnson, 25, of Mitchell, denied violating probation for a previous conviction of a third-offense DUI, a Class 6 felony; Pleaded not guilty to a fourth-offense DUI, a Class 5 felony; Driving with a revoked license, a Class 1 misdemeanor; and resisting the legal process, a Class 2 misdemeanor; Next court appearance scheduled for March 17.
  • Matthew Sweeney, 35, of Mitchell, pleaded guilty to possession of methamphetamine; Sentencing scheduled for April 14.
  • Julie Krogman, 48, of Mitchell, pleaded guilty to a first-offense DUI; Sentenced to 97 days in jail with 90 days suspended and credit for one day served; Must pay a $500 fine, $151 in prosecution costs, $86.50 in court costs and a $50 DUI surcharge; Must repay court-appointed attorney's fees.
  • Alec Dostal, 52, of Mitchell, was sentenced to 60 days in jail with 40 days suspended for driving with a revoked license; Must pay a $300 fine and $86.50 in court costs; Must repay court-appointed attorney's fees.
  • Desiree Apgar, 22, of Mitchell, admitted to violating probation for previous convictions of possession of a controlled substance in schedules I or II; Sentenced to four years in prison suspended with credit for 180 days served; Admitted to violating probation for a previous conviction of unauthorized ingestion of a controlled substance in schedules I or II, a Class 5 felony; Sentenced consecutively to five years in prison suspended with credit for 34 days served; Sentenced to two years probation; Must repay all previously ordered amounts; Must repay court-appointed attorney's fees.
