WAGNER — Two men were arrested Sunday following an incident alleged to have involved an intoxicated person pointing a gun at people while in a stolen truck.

At about 5:45 p.m., law enforcement received a report of someone driving a red Ford pickup and pointing a gun at people in the Marty area.

Aaron Irons, 19, of Sioux Falls, and Mahlon Kirkie, 18, of Mitchell, were found with the truck about 15 minutes later. The truck was reportedly in a ditch at the intersection of 393rd Avenue and 299th Street, southwest of Wagner. The truck was identified as having been reported stolen from Mitchell.

According to court documents, Irons said Kirkie had stolen the truck and had picked him up to drive it. A loaded pistol allegedly found on Kirkie was seized.

Irons and Kirkie were taken to the Charles Mix County Jail and reportedly gave PBTs of 0.157 and 0.134, respectively.

Both men were charged with grand theft of between $5,000 and $100,000, a Class 4 felony, and underage drinking, a Class 2 misdemeanor. Kirkie was additionally charged with committing a felony while armed, a Class 2 felony; and possession of a loaded firearm while intoxicated, a Class 1 misdemeanor.

If convicted on all felony charges, Irons could be sentenced to up to 10 years in prison, and Kirkie could be sentenced to up to 35 years.
