A Mitchell man was arrested recently for allegedly kicking a door open and being aggressive toward a man.

Dustin Zephier, 22, is charged with first-degree burglary, simple assault and second-degree intentional damage to property of $400 to $1,000.

At about 4 a.m. on April 20, Zephier began knocking on and kicking the door to an apartment building, according to court documents. The noise reportedly woke up a man and woman, who told Zephier to leave.

Zephier then allegedly kicked in the door, causing about $750 in damage to the door and door jamb, and got into a fighting stance toward the man. The man responded by hitting Zephier in the head with a closed fist in self-defense.

If convicted on all charges, Zephier could be incarcerated for up to 27 years.
