Moved by Allen, seconded by Tjarks, to approve Resolution #R2019-54, A Resolution of Intent to Amend Business Improvement District #2 to Extend Sports and Events Authority Funding, as follows:
A RESOLUTION OF INTENT TO AMEND BUSINESS IMPROVEMENT DISTRICT NO. 2 WITHIN THE CITY OF MITCHELL BY EXTENDING THE TERM OF THE PER ROOM PER NIGHT TAX ON RENTALS OF MOTEL AND HOTEL ROOMS IN RELATION TO THE SPORTS AND EVENTS AUTHORITY.
WHEREAS there is in effect in the City of Mitchell, SD, Business Improvement District (BID) No. 2 which provides for the imposition and collection of a tax of $1.50 on transient guests on rooms rented by lodging establishments within BID No. 2 on a per night per room basis and provided for the allocation and application of funds thereby raised, such amount being a fair and equitable method of raising revenue; and
WHEREAS One-half Dollar ($0.50) of said tax is designated towards the operations of the Sports and Events Authority and said portion of the tax is scheduled to expire on October 31, 2019; and
WHEREAS the City, Sports and Events Authority, and a majority of the members of BID #2 would like to renew said tax for an additional 5 year term.
THEREFORE, the City Council of the City of Mitchell, SD by this Resolution of Intent, enacted pursuant to SDCL 9-55-7, as amended resolve as follows:
1. The effective term for One-half Dollar ($0.50) of the per room per night occupied room rental for support of the Sports and Events Authority will be renewed for an additional 5 year term and will automatically terminate on October 31, 2024 unless further renewed by subsequent ordinance.
2. The boundaries and businesses included therein will remain is previously established.
3. The Mitchell City Council shall conduct a hearing on said proposed amendments and modifications to BID # 2 at the regular City Council Meeting on September 3, 2019 at 6:00 P.M. in the City Council Chambers at 612 N Main, at which time all parties affected by the amendments and modifications to BID No. 2 as described herein may appear and be heard as provided by law. The City shall cause notice of hearing to be made by mail to all parties affected not less than thirty (30) days prior to the hearing.
Motion carried and resolution declared duly adopted.
There being no further business to come before the meeting, Mayor Everson adjourned the meeting.
