NOTICE OF SOLID WASTE PERMIT AMENDMENT AND RECOMMENDATION CITY OF MITCHELL SOLID WASTE FACILITY by the Department of Environment and Natural Resources The South Dakota Department of Environment and Natural Resources (DENR) has received an application from the city of Mitchell to amend the permit for the operation of a Type IV solid waste facility located in portions of Section 25 and Section 26, Township 103 North, Range 60 West, Davison County, South Dakota.

The South Dakota Department of Environment and Natural Resources (DENR) has received an application from the city of Mitchell to amend the permit for the operation of a Type IV solid waste facility located in portions of Section 25 and Section 26, Township 103 North, Range 60 West, Davison County, South Dakota. The facility is located one mile east of Mitchell. Total acreage of the site is approximately 84 acres. The facility serves Davison County and the surrounding region. The permit amendment will be granted for a period ending February 21, 2022, as provided for under South Dakota Codified Law (SDCL) 34A-6-1.16.
DENR has reviewed the proposed amendment, has reached a tentative decision and recommends to the Board of Minerals and Environment (board) that the permit be amended to allow the facility to increase the annual maximum tonnage of wastes accepted for disposal from 499 tons to 4,999 tons. The proposed amendment also confirms that wind turbine blades can be disposed of at the facility.
The recommendation for amendment of this permit is subject to the applicant's compliance with the Administrative Rules of South Dakota (ARSD) 74:27 and SDCL 34A-6.
In accordance with SDCL 34A-6-1.14 and SDCL 34A-6-1.15, DENR's recommendation for approval will become the final decision and the amendment to the permit will be issued 30 days after publication of this notice. A person adversely affected or having an interest adversely affected by the DENR's recommendation for approval of this amendment to the permit may petition the board for a contested case hearing. The petition must comply with the requirements of ARSD 74:09:01:01. If a petition for such a hearing is not filed within 30 days of this publication date, a permit amendment will be formally and finally granted at that time.
