A Judgment and Decree of Foreclosure, having been filed on June 17, 2019, by the Circuit Court for the First Judicial Circuit, Davison County, in the action entitled Idaho Housing & Finance Association v. Derik D. Nespor, et al, Civ. 17CIV19-000094, which Judgment and Decree of foreclosure in part directed a foreclosure sale of the following described real property in Davison County, South Dakota:
LOT SEVEN (7), BLOCK ELEVEN (11), GLEESON'S ADDITION TO THE CITY OF MITCHELL, DAVISON COUNTY, SOUTH DAKOTA, ACCORDING TO THE RECORDED PLAT THEREOF AS FILED FOR RECORD IN BOOK 8 OF MISCELLANEOUS RECORDS PAGES 174-175 THEREOF ON JUNE 4, 1903 IN THE REGISTER OF DEEDS, DAVISON COUNTY, SOUTH DAKOTA.
(aka 1100 E. 2nd Ave., Mitchell, SD 57301)
Together with all improvements, easements, rights and appurtenances on or accruing to such property;
NOTICE IS HEREBY GIVEN that for the purpose of realizing the sum of $75,058.80 as of June 17, 2019, plus interest accruing thereafter on said amount at the rate of 3.875% per year together with the costs and expenses of sale, will be sold subject to redemption as provided by law as one parcel of land at public auction subject to the lien for unpaid real estate taxes and assessments of Davison County, South Dakota, and easements and restrictions of record, to the highest bidder for cash, by the Sheriff of Davison County, at the Davison County North Annex Building in Mitchell, South Dakota at the hour of 10:00 AM CT on August 29, 2019. Such property is that described in a Promissory Note and Mortgage dated March 24, 2017, recorded March 24, 2017 in Document #:R 170581 Book: M317 Page: 124; which mortgage was assigned to Idaho Housing and Finance Association by Assignment of Mortgage recorded March 21, 2019 in Document # R 190512 Book A 419 page 0018, executed by Derik D. Nespor.
If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor or the Mortgagee's attorney.
