DRAINAGE BOARD February 21, 2023 CALL TO ORDER Drainage Administrator Bathke called the regular meeting of the Davison County Drainage Board to order at 7:00 p.m. Drainage Administrator Bathke took roll call as follows: Members of the Board present were Jay Larson, Jerry Buchholz, Gregg Bult, Mark Klumb, Denny Kiner. Ex-Officio members present were Drainage Administrator Bathke and Deputy Drainage Administrator Wegleitner. Absent-Chris Nebelsick, Chet Edinger, Auditor Kiepke, Highway Superintendent Weinberg, and DOE Love. Guests – Merle and Diane Bechen. OATH OF OFFICE As this was the first Drainage Board meeting of the year, Drainage Administrator Bathke administered the oath of office to all Drainage Board members present. ELECT CHAIRPERSON Drainage Administrator Bathke called for nominations for a chairperson. Motion by Kiner, second by ¬¬¬¬¬¬¬¬¬-Klumb to nominate Larson as chairman. Drainage Administrator Bathke called for other nominations three times. Hearing none, motion by Buchholz, second by Klumb to cease nominations and cast a unanimous ballot for Larson. A roll call vote was taken as follows. Buchholz–Yes, Bult–Yes, Edinger–Absent, Larson-Abstain, Kiner–Yes, Nebelsick–Absent, Klumb–Yes. Motion carried. CHAIRMAN TAKES OVER MEETING At this time, Chairman Larson took over the remainder of the meeting. ELECT VICE-CHAIRPERSON Chairman Larson called for nominations for a vice-chairperson. Motion by Bult, second by Klumb to nominate Edinger as vice-chairman. Chairman Larson called for other nominations three times. Hearing none, motion by Larson, second by Bult to cease nominations and cast a unanimous ballot for Edinger. All members present voted aye. Motion carried. MEETING EXPECTATIONS Chairman Larson explained expectations of the meeting and criteria considered for each application. A checklist of items required in accordance with the Davison County Drainage Ordinance and SDCL 46A-10A will be considered on each permit. The checklist is on file in the Davison County Auditor’s office and the Drainage Administrator’s office. APPROVE AGENDA Motion by Buchholz, second by Kiner to approve the agenda for the February 21, 2023, meeting. All members voted aye. Motion carried. DECLARE CONFLICTS OF INTERESTS Chairman Larson asked for any conflicts of interests. No conflicts were declared. APPROVE MINUTES Motion by Klumb, second by Bult to approve the minutes of the October 11, 2022, meeting. All members voted aye. Motion carried. PUBLIC COMMENT & CITIZEN COMPLAINTS Chairman Larson asked for any public input for items not on the agenda and reminded them that no action will be taken. BECHEN DRAINAGE Merle Bechen has applied to the Davison County Drainage Commission to recommend granting a drainage permit. This request is pursuant to Article 2 of the Davison County Drainage Ordinance as adopted on 8/27/2013. The property to be drained, or involved in the project, is legally described as the E 1,513.27’ of the SW1/4 Lying south of I-90 EX Lot A of Bechen’s Addition of Section 32, Twp 103 Rge 60 Davison County. The outlet will be in the same quarter. The applicant was present to answer questions. The plan is to install a 581’ long ditch, 30’ wide with a 13’ bottom with a 1:4 slope on the sides. The ditch will outlet into County Coordinated Ditch #5, which outlets into Kibbee Ditch, then Enemy Creek, then the James River, then the Missouri River. a. Application received January 11, 2023. b. Applicant and necessary neighbors notified February 8, 2023. c. Published in the paper February 11, 2023. Administrator Bathke explained he received one call from abutting property owners, which was Arlen Schuh. This project will not affect his property. Mr. Bechen explained he would like to access the ground on the north side of the project. Based on the findings, motion by Kiner, second by Buchholz to approve the application. A roll call vote was taken as follows. Buchholz–Yes, Bult–Yes, Edinger–Absent, Larson-Yes, Kiner–Yes, Nebelsick–Absent, Klumb–Yes. Motion carried. ADMINISTRATIVELY APPROVED APPLICATIONS Administrator Bathke informed the board there was one Administratively Approved Application for Tom Bannwarth on October 20, 2022. An open ditch with an 8’ bottom with a 1:4 slope on the sides. The project is approximately 5,100’ long, but the center portion of the ditch is not being excavated. The project will clean out County Coordinated Ditch #2 in Sections 11 and 14-104-62, which is a 3-dot blue line. This ditch contains excessive trees and erosion, causing a lack of water flow. Removing the trees and debris will allow water to flow freely in the ditch. The SW ¼ of Section 11-104-62, which was previously cleaned out, is included in this application in the event additional landscaping is needed to allow the water to flow. This will eventually drain into Upper Firesteel Creek, then Lake Mitchell, Lower Firesteel Creek, and the James River. Informational only, no vote required. MISCELLANEOUS ITEMS Administrator Bathke informed the board of one pending application from Calvin Luebke, who would like to drain tile the NE ¼ of Section 33-101-61 and outlet the water into the 403rd road ditch or into the stock dam in the NE corner. The board was not supportive of either outlet location and recommended Mr. Luebke find an alternative route to the blue line. SET DATE AND TIME FOR NEXT MEETING Chairman Larson set March 21, 2023, at 7:00 p.m. as the next meeting date and time. ADJOURN At 7:30 p.m., Chairman Larson adjourned the meeting.
