401 CERTIFICATION 15-DAY PUBLIC NOTICE The South Dakota Department of Agriculture and Natural Resources (DANR) has received an application for state certification under Section 401 of the Clean Water Act. The U.S. Army Corps of Engineers (Corps), Omaha District, proposes to reissue Regional General Permit (RGP) 00-05 for construction of bank stabilization projects either by the Corps or the South Dakota Department of Game, Fish, and Parks to prevent destruction of culturally significant sites at Corps lakes on the Missouri River mainstem. This RGP covers Missouri River mainstem lakes in Montana, North Dakota, and South Dakota. The South Dakota lakes covered under this RGP include Lake Oahe, Lake Sharpe, Lake Francis Case, and Lewis and Clark Lake. The DANR water quality certification request is only applicable to waterbodies within the South Dakota state boundary. The Corps provided a public notice to this project and a public comment period from November 8, 2022, through November 29, 2022. However, DANR is providing additional information to comply with Administrative Rules of South Dakota (ARSD) 74:51:01:64.03. Written comments regarding this proposed project must be received by the department on or before March 20, 2023. Any person may request, in writing, within the 15-day comment period, that a public hearing pursuant to ARSD Chapter 74:50:02 be held to consider the application.
