B-Y Water District (Owner) is requesting Bids for the construction of the following Project:
SD Highway 44 Water Main Relocation
Bids for the construction of the Project will be received at the B-Y Water District Office located at 31039 428th Avenue, Tabor, South Dakota 57063, until April 2, 2020 at 2:00 pm local time. At that time the Bids received will be publicly opened and read.
The Project includes the following Work:
Construction and relocation of approximately 0.9 mile of 1 ½", 2", 3" and 4" PVC water main and services, gate valves with and without boxes, 1 ½" ball valves with and without boxes, 542 feet of PVC pipe installed by directional drilling, tie-ins, fittings, seeding and mulching, traffic control and other appurtenant and incidental work as more fully enumerated in the Bidding Documents.

Obtaining the Bidding Documents
The Issuing Office for the Bidding Documents is:

Prospective Bidders may obtain or examine the Bidding Documents at the Issuing Office on Monday through Friday between the hours of 8 am to 5 pm, and may obtain printed copies of the Bidding Documents from the Issuing Office as described below. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including addenda, if any, obtained from sources other than the Issuing Office.
Bidding Documents may be purchased from the Issuing Office during the hours indicated above. In accordance with SDCL 5-18B-1, these documents, upon request therefore, will be furnished without charge to each contractor resident in South Dakota who intends, in good faith, to submit a Bid. Checks for Bidding Documents shall be payable to "Johnson Engineering Company". Upon Issuing Office's receipt of payment, printed Bidding Documents will be sent via delivery service.

Each Bid must be accompanied by Bid security which may consist of either a certified check, a cashier's check or draft, for five percent (5%) of the amount Bid, such check or draft to be certified or issued by either a South Dakota bank or a national bank and payable to "B-Y Water District" or in lieu thereof, a Bid Bond for ten percent (10%) of the amount Bid, such bond to be issued by a surety authorized to do business in the State of South Dakota and payable to "B-Y Water District".
The Successful Bidder will be required to furnish a Performance Bond and a Payment Bond as security for the faithful performance and the payment of all bills and obligations arising from the performance of the Contract. Required Contract Bonds are explained in the Bidding Documents.
Bidders on this work will be required to comply with the Presidents Executive Order Nos. 11246 (Equal Employment) as amended, 11518 (Small Business Concerns), and 11625 (MBE) as amended. The requirements for Bidders and Contractors under these orders are explained in the Bidding Documents.
Bidders on this work will be required to comply with Title 40 CFR 33.240 and Executive Order 12138 (WBE). The requirements for Bidders and Contractors under this regulation which concerns utilization of Disabled Business Enterprises (DBEs) are explained in the Bidding Documents. The DBE goals for participation in this contract in terms of percentage of contract value are as follows:
Bidders on this work will be required to comply with Title 41 CFR 60 and Executive Order 11246 (EEO). The requirements for Bidders and Contractors under this regulation which concerns utilization of Equal Employment Opportunity (EEO) and Affirmative Action Requirements are explained in the Bidding Documents. The goals and timetables for minority and female participation in this contract in terms of percentage of contract value are as follows:
Goals for minority participation in each trade - 1.2%
Goals for female participation in each trade - 6.9%
Bidders on this work will be required to comply with the Buy America Act as explained in the Bidding Documents.
Bidders on this work will be required to comply with the Davis-Bacon Act and Federal Labor Standards Provisions as explained in the Bidding Documents.
Owner reserves the right to reject any and all Bids, including without limitation the right to reject any or all nonconforming, nonresponsive, unbalanced, or conditional Bids, and to reject the Bid of any Bidder if Owner believes that it would not be in the best interest of Owner to make an award to that Bidder. Owner also reserves the right to waive informalities.
If the Contract is to be awarded, Owner will give the Successful Bidder a Notice of Award within the number of days set forth in the Bid Form for acceptance of the Bid. The Owner reserves the right to retain the Bid Security until thirty (30) days after the Bid Opening. Bids shall hold firm during this period.
A pre-bid conference for the Project will not be held.
