Defense in Pierre shooting case can survey public

PIERRE (AP) — Lawyers of a 17-year-old boy accused of murder have received permission to conduct a public survey on the trial.

The survey may influence whether the boy's lawyers seek to change the trial's venue.

The trial of Braiden McCahren of Pierre is currently set for June 2 in Hughes County. He will be tried as an adult.

He pleaded not guilty in the December 2012 shooting death of 16-year-old Dalton Williams.

The defense in a hearing Tuesday said the court had no right to temporarily halt their survey and the questions are neutral. The judge concurred.

An attorney for the state says the survey could reach prospective jurors and should be reviewed in advance.

Another hearing will be held May 12 for possible motions.
