Mitchell teen gets suspended sentence for rape

A Mitchell man received a suspended imposition of sentence Tuesday for a rape conviction.

Dustin Chernotik, 19, appeared in court at the Davison County Public Safety Center.

He pleaded guilty to fourth-degree rape in January, which means the victim was between 13 and 16 years old and the perpetrator is more than three years older than the victim.

Chernotik's attorney Rebecca Milan requested the suspended imposition of sentence, which means if he abides by all the rules of his probation period, he has the chance to clear the felony from his record. She said Chernotik is remorseful and knows what he did was wrong.

He admitted to having sexual intercourse with a teenage girl in November.

Chernotik apologized for his actions, and particularly apologized to the victim, her family and his family.

Judge Tim Bjorkman said letters of recommendation from Chernotik's family, officials at Mitchell Career and Technical Education Academy and the victim and her family spoke very highly of Chernotik.

Bjorkman granted the suspended imposition of sentence and imposed 45 days of jail time, $104 in court costs, plus additional prosecution costs, court-appointed attorney fees and three years of probation. Chernotik must not be alone with children younger than 18 and must maintain full-time gainful employment.

"You have an opportunity to rebuild your life from here. Make the most of it," Bjorkman said.
