Mitchell man runs but can’t hide from 3rd charge of DUI

A Mitchell man was arrested Saturday for third-offense drunken driving.

Cadden Burgess, 22, was stopped shortly after midnight by an officer with the Mitchell Police Division who saw a pickup driving at a high rate of speed in the 1400 block of South Rowley Street, court documents say.

The officer located the vehicle in the Dakota Manufacturing parking lot and saw a man, later identified as Burgess, running from the vehicle.

Burgess was located by the officer about 150 yards from the vehicle and was found to be intoxicated and smelling of alcohol, court documents say.

Burgess denied being the driver of the vehicle, but the officer theorized that was a lie after speaking to the passenger and examining footprints left in fresh snow near the driver’s door of the vehicle.

An open whiskey bottle was located inside the vehicle and Burgess’ license was found to be suspended, court documents say.

Burgess is charged with third-offense drunken driving, a felony, and obstructing law enforcement, driving with a suspended license and having an open alcohol container in a vehicle, all misdemeanors.

He faces a maximum penalty of two years in prison and a $4,000 fine for the DUI.
