Man pleads not guilty to escape

A Mitchell man pleaded not guilty Tuesday to second-degree escape for allegedly failing to return to jail after a furlough.

Joshua Carter, 22, was arrested Sept. 17 after he was allegedly found lying in Dry Run Creek Park in an intoxicated state. A Mitchell police officer found Carter with two air duster cans next to him, indicating recent use, according to court documents.

Carter faces a maximum penalty of five years in prison and a $10,000 fine.

His trial is scheduled for December.
