Mitchell man gets two years for rape
A Mitchell man was sentenced to two years in prison for fourth-degree rape of a 15-year-old girl.
Kody Dean Butterfield, 20, was sentenced Tuesday during court at the Davison County Public Safety Center.
Butterfield committed the crime in May when he was 19. The girl was 15, which is legally not old enough to consent to sex, even though the sexual acts in question were described as consensual in nature.
Judge Tim Bjorkman ordered Butterfield to serve 10 years in prison but suspended eight years.
He ordered Butterfield pay $104 in court costs, repay court-appointed attorney fees and pay for a psychosexual evaluation. Bjorkman also gave him credit for 118 days served. His first parole eligibility will be in March 2014.
