Mitchell man back in jail after huffing

A Mitchell man is in jail after failing to return after a furlough.

Joshua Carter, 22, is charged with second-degree escape, which is punishable by up to five years in prison, a $10,000 fine or both.

He was on furlough to complete a treatment program at Stepping Stones in Mitchell. He completed the program on Sept. 12 and was scheduled to immediately return to jail after that.

He was allegedly found around 3 p.m. Sept. 17 lying in Dry Run Creek Park in an intoxicated state.

Court documents state a Mitchell police officer found him with two air duster cans next to him, one of which was still cold, indicating recent use. The officer stated Carter did not smell of alcohol.

Carter was arrested for ingesting an intoxicant other than alcohol, a misdemeanor, and booked in the Davison County Jail.
