A Mitchell School District counselor on Wednesday was found not guilty of failing to report child abuse or neglect.
Erin Fowkes, 49, had been charged with the Class 1 misdemeanor after being accused of not reporting an incident when Bonfilio Sanchez Jr., 17, went to her home the night of April 9. Sanchez testified Wednesday that he told Fowkes that he and his mother got into a fight and that his mother swiped his face and threatened to get a stick.

The jury in a Mitchell School District counselor's trial has been deliberating since approximately 4 p.m. to determine if the counselor is guilty of failing to report child abuse or neglect in an incident earlier this year.
A Mitchell High School counselor is scheduled to be arraigned Thursday on charges that she failed to report child abuse or neglect to authorities.
Erin Fowkes appeared in Davison County Court last week for a preliminary hearing on the charge, for which she was arrested April 22.
