A Mitchell woman pleaded guilty Tuesday to third-offense drunken driving.
Yolanda Garza, 45, was arrested around 2 a.m. Dec. 7 after police found her passed out in her vehicle, which was running and parked in the 200 block of West Fifth Avenue. Her blood alcohol content was found to be 0.232 shortly after her arrest. The legal limit for driving in South Dakota is 0.08.
Garza’s prior DUIs are from 2005 and 2006.
Prosecutors agreed to recommend she receive a suspended prison term and not to object if she asks for a suspended imposition of her sentence. A suspended imposition of sentence gives offenders the opportunity to keep a clear record if they follow all terms of probation.
A presentence investigation was ordered. Sentencing was scheduled for March.
