Mitchell man pleads guilty to third DUI

He faces a felony charge and a maximum of two years in prison and a $4,000 fine.

A 46-year-old Mitchell man pleaded guilty Tuesday to third-offense drunken driving.

Richard Sellers was arrested Sept. 15 after a South Dakota Highway Patrol trooper observed him make an illegal right turn from Fifth Avenue onto Sanborn Boulevard in Mitchell, and noticed Sellers wasn’t wearing a seat belt. During the traffic stop, Sellers failed a series of field sobriety tests and was arrested for DUI.

Because Sellers has two prior convictions for DUI within the last 10 years, he faces a felony charge and a maximum of two years in prison and a $4,000 fine.

A presentence investigation was ordered. Sentencing is scheduled for next month.
