A Letcher man is charged with drunken driving after crashing into a ditch on a rural road a few miles west of Lake Mitchell.

At about 11:30 p.m. Sept. 29, Scott Brian Phillips, 54, allegedly drove his vehicle into a ditch near the intersection of 404th Avenue and 250th Street, where the vehicle became stuck on a rock pile and culvert, court documents say.

Davison County Sheriff’s Deputy Steve Harr responded to the incident and allegedly found Phillips still behind the wheel of his vehicle.

Phillips fell to the ground twice while attempting to walk from his vehicle to Harr’s vehicle, court documents say.

Phillips’ blood alcohol content was found to be 0.188 around the time of his arrest. The legal limit for driving in South Dakota is 0.08. He is charged with second-offense DUI and open alcohol container in a motor vehicle. Both charges are misdemeanors.

Phillips is scheduled to appear in court later this month.
