A Sioux Falls man was arrested last week in Mitchell for allegedly driving with a blood-alcohol content nearly four times the legal limit.
Gabriel Hofer, 31, was arrested shortly before 9 p.m. Sept. 19 after the Mitchell Police Division received a report of a car that nearly crashed into a semi on Interstate 90.
The car turned off I-90 and was driving on Burr Street when Highway Patrol Trooper Jason Brandt got behind the vehicle and saw it swerve and nearly hit the curb, court documents say. Brandt stopped the vehicle, which nearly struck the curb again as it pulled over.
Brandt found Hofer behind the wheel of the car. Hofer then allegedly failed a field sobriety test and was found to have a blood alcohol content of 0.311 around the time of his arrest. The legal limit for driving in South Dakota is 0.08.
Hofer was arrested and charged with first-offense drunken driving, open alcohol container in a motor vehicle and erratic lane driving.
Hofer is scheduled to appear in court in October.
