Mitchell man charged with third DUI, a felony

A Mitchell man was arrested Sept. 15 and charged with third-offense drunken driving.
Highway Patrol Trooper Micheal Peterson stopped Richard Berdette Sellers, 44, after he observed Sellers make an illegal right turn from Fifth Avenue onto Sanborn Boulevard and noticed Sellers wasn’t wearing a seat belt, court documents say.
After Sellers allegedly failed a series of field sobriety tests, Peterson arrested him for drunken driving. Because Sellers has two prior convictions for DUI within the last 10 years, he is charged with a felony and faces a maximum of two years in prison and a $4,000 fine. He is also charged with a seat belt violation.
Sellers is scheduled to appear in court later this month.
