Mitchell man charged with breaking window, kicking officer

A Mitchell man was arrested Sept. 6 for allegedly breaking a window on a police car and kicking an officer.

A Mitchell man was arrested Sept. 6 for allegedly breaking a window on a police car and kicking an officer.

Bernard Drapeau III, 30, is charged with simple assault of a law enforcement officer, obstructing a law enforcement officer and intentional property damage.

He faces a maximum of two years in prison and a $4,000 fine if convicted of the assault charge, which is a felony. The remaining charges are misdemeanors.

The charges stem from an incident in which Drapeau was placed in the back of a patrol car after Mitchell police spoke with him regarding suicidal statements he made and found he was intoxicated, a police affidavit says. Once inside the vehicle, Drapeau allegedly broke out the rear passengerside window and exited the vehicle, but was caught and handcuffed by nearby officers. One of the officers was allegedly kicked in the process of taking Drapeau back into custody.

Drapeau is scheduled to appear in court later this month.
