A Mitchell man who was scheduled for sentencing Tuesday showed up late and will now spend the next week in jail for failure to contact the court to finish a pre-sentence investigation.

Colin Stands, 18, was five minutes late for his sentence hearing Tuesday. He was to be sentenced for aggravated assault. He was arrested in March for hitting a person with a baseball bat.

After a brief meeting with his attorney, Phil Carlson, Stands appeared before Judge Rodney Steele.

“Court services was unable to complete the pre-sentence investigation in this case because Mr. Stands did not contact them,” Carlson said. “He apologizes profusely for that.”

Steele granted a one-week extension on the condition that Stands remains in custody at the Davison County Jail to finish the PSI.

Steele scheduled a sentence hearing for next week.
