The following cases were disposed of in Davison County Magistrate Court between May 1 and May 17.

• David L. Phillips, 65, 165 N. Harmon, Mitchell; driving with suspended (not revoked) license; $204 fine; $66 costs.

• Ashton Cooper Rew, 16, 515 E. Sixth, Mitchell; driving with suspended (not revoked) license; $204 fine; $66 costs.

• Twila Jean Hislaw, 31, 600 W. 15th Ave., Apt. 22, Mitchell; seat belt violation, $25 fine.

• Tanner Frank, 16, 207 N. Main St., Mount Vernon; speeding other roadways, $59 fine; $66 costs.

• Denet Victor Christopher, 22, 4904 W. 47th St., Sioux Falls; eluding, $300 fine; $84 costs; suspended imposition of sentence on these conditions: pay fine and costs; obey all laws; court retains jurisdiction for 360 days; turn in license to Clerk of Courts office and to be held there for 30 days, must not drive for 30 days.

• Elmer Scott Pickner Jr., 22, 1009 W. Fourth Ave., #2, Mitchell; disorderly conduct, $150 fine; $50 suspended; $66 costs; 10 days in jail; 10 days suspended on these conditions: pay fine and costs; obey all laws; court retains jurisdiction for six months; repay court appointed attorney fees; enroll and complete the DAP program, and provide proof to Clerk of Courts office.

• Elmer Scott Pickner Jr., 22, 1009 W. Fourth Ave, #2, Mitchell; possession of two ounces of marijuana or less; $1,000 fine; $700 suspended; $84 costs; 90 days in jail; 88 days suspended on these conditions: pay fine and costs; obey all laws; court retains jurisdiction for 360 days; repay court appointed attorney fees; needs to check in with jail by Friday to set up days for jail; jail time needs to be done within 15 days.

• Randy Dean Kirchhevel, 32, 212 W. Norway Ave., Mitchell; violation of protection order, $1,000 fine; $700 suspended; $84 costs; 180 days in jail; 180 days suspended on these conditions: pay fine and costs; obey all laws; court retains jurisdiction for 360 days; obey any and all protection orders or court orders.

• James Luverne Foster, 36, 3301 River Bluff Road, Mitchell; disorderly conduct, $150 fine; $66 costs; 30 days in jail; 30 days suspended on these conditions: pay fine and costs; obey all laws; court retains jurisdiction for six months; no contact with the victim.

• Harold Dean Miller, 48, 415 E. Seventh Ave., Mitchell; possession of two ounces of marijuana or less, $1,000 fine; $750 suspended; $84 costs; 90 days in jail; 88 days suspended; fishing without license, $54 fine; $66 costs; five days in jail; five days suspended; jail time suspended on these conditions: pay fine and costs; obey all laws; court retains jurisdiction for 360 days; jail time must be done; can have work release if serves days back to back; loses fishing license for one year.

• Mark Kenneth Harrison, 52, 104 Cliffs Drive, #5, Chamberlain; driving under the influence, first offense; $750 fine; $228.50 costs; suspended imposition of sentence on these conditions: pay fine and costs; obey all laws; court retains jurisdiction for 360 days; obtain alcohol evaluation at own expense and comply with any recommendations; verification of evaluation furnished to court and to state’s attorney’s office.

• Dillion Dean Ducheneaux, 19, HCR 30 Box 25, Mobridge; driving under influence, first offense; $300 fine; $228.50 costs; 60 days in jail; 60 days suspended on these conditions: pay fine and costs; obey all laws; court retains jurisdiction for 360 days; work/school permit granted upon proof of insurance and employment and turn in valid driver’s license; obtain an alcohol evaluation at own expense and comply with recommendation made; verification of evaluation must be furnished to the court and state’s attorney’s office.
