Mitchell man gets prison for probation violation

A 32-year-old Mitchell man was sentenced to three years in prison Tuesday for drinking and using marijuana while on probation.

A 32-year-old Mitchell man was sentenced to three years in prison Tuesday for drinking and using marijuana while on probation.

Gordon Hart had three years of a 10-year prison sentence reinstated by Judge Sean O’Brien after Hart violated his probation on March 13. He tested positive for marijuana and was found to have a blood alcohol content of 0.268 by Davison County Court Services. The state legal limit is 0.08.

The 10-year prison sentence was first suspended after Hart was convicted of felony drug possession in 2010. Hart was given credit for the 70 days served prior to Tuesday’s hearing.
