Attempted murder conviction upheld in LNI shooting

PIERRE (AP) — The South Dakota Supreme Court has upheld a Rapid City man's conviction for attempted murder in a shooting outside the 2009 Lakota Nation Invitational basketball tournament.

Twenty-two-year-old Simon Torres was sentenced to 50 years in prison after a jury convicted him of attempted murder and commission of a felony with a firearm for the shooting of Shane Bordeaux.

Torres argued his trial was unfair because a judge allowed the jury to see a bystander's blurry video of the shooting with digital tags added to identify the shooter and victim. The Supreme Court says labels in the video did not insinuate Torres was the shooter, and witnesses testified that Torres fired the shots.

The high court also upheld the use of hospital photos as evidence to show the gunshot wounds.
