Points-related driving offenses in South Dakota

State law currently makes any driver who accumulates 15 points in any 12-month period or 22 points in any 24-month period subject to driver’s license suspension.

State law currently makes any driver who accumulates 15 points in any 12-month period or 22 points in any 24-month period subject to driver’s license suspension.

The length of license suspensions increases with the number of offenses — first suspensions last a maximum of 60 days, second suspensions last a maximum of six months and any subsequent suspensions last a maximum of one year.

State law requires a license revocation for any driving while intoxicated charge.

Current points-related driving offenses in South Dakota are:

-Driving while intoxicated, 10 points.

-Reckless driving, 8 points.

-Eluding/attempting to elude, 8 points.

-Drag racing, 6 points.

-Failure to yield right-of-way, 4 points.

-Improper passing, 4 points.

-Driving on the wrong side of the roadway, 4 points.

-Stop sign/light violation, 3 points.

-Other moving violations, 2 points. (State law specifically excludes speeding from this category.)

Points-related offenses removed by 1986 Senate Bill 204:

-Speeding on an interstate highway: 16 to 20 mph over the limit, 2 points; more than 20 mph over the limit, 3 points.

-Speeding other than on interstate highways: One to 5 mph over the limit, 1 point; six to 10 mph over the limit, 2 points; more than 10 mph over the limit, 3 points.
