SIOUX FALLS (AP) — A lawyer for a South Dakota bar owner accused of raping a 12-year-old and two 14-year-olds at a Huron tavern where authorities say he served alcohol has asked to be recused from the case.
Jeff Burns was appointed by a Beadle County judge to represent 34-year-old Werner Fajardo. Authorities say Fajardo assaulted the three girls at the El Cuervo bar.
Burns filed a motion asking to be removed from the case because he recently learned that he had previously represented a witness in the case.
Fajardo has pleaded not guilty to six counts of rape and several counts of providing alcohol to minors and is awaiting trial. Police say Fajardo met the girls he's accused of raping through teen nights held at the bar.
