Lower Brule man arrested on multiple charges in Mitchell

The Mitchell Police Division arrested a Lower Brule man Friday for third offense driving under the influence, possession of marijuana and several other charges.

The Mitchell Police Division arrested a Lower Brule man Friday for third offense driving under the influence, possession of marijuana and several other charges.

Officer Russ Stevenson said he saw Robbie Her Many Horses, 31, pull out of Casey’s General Store parking lot around 2:20 p.m. and drive southbound on Main Street. Stevenson said Her Many Horses ran a red light at Seventh Avenue and Main Street, so he pulled him over at Fifth Avenue.

“I could tell he was intoxicated,” Stevenson said.

When Stevenson asked Her Many Horses to come to his squad car, Her Many Horses “kept putting his hands in his pockets and finally took out a bag of marijuana and Zig Zag papers, and threw them on the sidewalk.”

A woman had called in a hitand-run, and a drunk driver in the Casey’s parking lot just as Stevenson started following Her Many Horses. Stevenson said there was about $100 damage to the other vehicle.

Her Many Horses was charged with felony DUI, no driver’s license, hit-and-run, failing to stop at a red light, open container, possession of 2 ounces or less of marijuana and possession of drug paraphernalia.

For the third DUI charge, Her Many Horses faces up to two years in prison, a $4,000 fine or both.

The other charges are misdemeanors.

He was not in custody in the Davison County Jail Monday, but no details on his release were available.
