Judge OKs release of some medical records in infant murder case

TYNDALL (AP) — A South Dakota judge is allowing a murder suspect to have access to some of his wife's medical records, but under tight restrictions.

Thirty-seven-year-old Chris Miller of Scotland is to stand trial in May on charges including murder in the March 2011 death of his 4-month-old son, Jacob. Authorities say Chris Miller shook and beat Jacob.

Defense attorneys have been seeking the medical records of Miller's wife, alleging that Stacy Miller was depressed before and after giving birth and was unstable. Her attorney says Miller's attorneys want to cast suspicion on her.

The media reports that Judge Glen Eng is releasing portions of Stacy Miller's medical records that he believes might be relevant to the case. But the records are only to be viewed by attorneys.
