STURGIS (AP) — The owner of an adult entertainment store in Sturgis has pleaded not guilty to five misdemeanor charges of allegedly violating a state law that limits where such businesses can be located.
The media that Dick and Jane's Naughty Spot owner David Eliason told a circuit court judge Monday that he intends to retain a lawyer soon. The judge set a hearing for Dec. 14.
The business remains open in Sturgis.
State law requires adult-oriented businesses to be at least a quarter mile from certain public areas.
Eliason contends the law is vague. He already has gone to court once, unsuccessfully trying to get a federal judge to force the city to give him a permit for a different site.
