ACLU, SD disagree on suit settlement compliance

The American Civil Liberties Union accused South Dakota on Monday of failing to comply with an agreement concerning voting rights for certain felons, but a state official responded the oversight wasn’t intentional.

The American Civil Liberties Union accused South Dakota on Monday of failing to comply with an agreement concerning voting rights for certain felons, but a state official responded the oversight wasn’t intentional.

The ACLU filed a lawsuit against the state in 2009 on behalf of Eileen Janis and Kim Colhoff, both of Pine Ridge, who argued they were illegally removed from the Shannon County voter registration list in 2008 following felony convictions in federal court that resulted in probation but no prison time.

A settlement reached last year called for then-Secretary of State Chris Nelson to propose rule changes to the state Election Board.

But the ACLU said current Secretary of State Jason Gant has failed to propose the rules changes.

Gant said he was never told about the requirement to propose a rule change.
