RAPID CITY (AP) - An advertising firm is challenging two initiated measures approved by Rapid City voters in June that restrict billboards within city limits.
According to media reports, Lamar Outdoor Advertising's lawsuit in federal court claims the restrictions have resulted in an unlawful taking of property without compensation, a violation of the Fifth Amendment. The company also claims that the sign ordinance violates the First Amendment right to free speech as well as the South Dakota Constitution.
The company seeks at least $75,000 or a ruling that the city code is unconstitutional.
Mayor Sam Kooiker says officials are still reviewing the lawsuit. He says the city will defend the restrictions.
