Man facing child porn charges faces competency hearing

A Mitchell man who pleaded not guilty to two charges of possessing child pornography will have his competency to answer charges called into question this summer.

A Mitchell man who pleaded not guilty to two charges of possessing child pornography will have his competency to answer charges called into question this summer.

Brandon Lane Myears, 27, appeared in court on Tuesday at the Davison County Public Safety Center in Mitchell with his lawyer, Tim Whalen.

Whalen requested a competency hearing for Myears. Judge Sean O’Brien scheduled the hearing for July.

Myears allegedly distributed images of child pornography to a law enforcement officer. At the time of his January arrest, he was also found to be in possession of at least two image files depicting child pornography.

Possessing, manufacturing or distributing child pornography is a Class 4 felony punishable by a maximum sentence of 10 years in the state penitentiary and a $20,000 fine.
