Jury deliberating case of Mitchell counselor accused of failing to report child abuse

The jury in a Mitchell School District counselor's trial has been deliberating since approximately 4 p.m. to determine if the counselor is guilty of failing to report child abuse or neglect in an incident earlier this year.

The jury in a Mitchell School District counselor's trial has been deliberating since approximately 4 p.m. to determine if the counselor is guilty of failing to report child abuse or neglect in an incident earlier this year.

Erin Fowkes faces the charge, a Class 1 misdemeanor punishable by a fine up to $2,000 and a year in jail.

Defense attorney Bill Fuller, of Sioux Falls, said Wednesday in Davison County court that Fowkes had no reason to suspect abuse in the case, which involved a student.
