Criminal charges are pending against the driver of a city bus that struck and knocked down two tourists last week near the Corn Palace, though the final determination of charges rests with the state’s attorney.

A spokeswoman for the state Department of Public Safety said Friday that the Highway Patrol completed its investigation of the accident and forwarded a report to Davison County State’s Attorney Pat Smith. He said the report contained a request that Julie Payne be charged with careless driving, which is a misdemeanor, and failure to yield to a pedestrian, which is a petty offense.
