Sex criminals in local court
Three men who were arrested last fall and accused of committing separate sex crimes against minors all made court appearances Tuesday at the Davison County Public Safety Center in Mitchell.
Two of the men pleaded guilty to their respective charges, while a third was sentenced to jail time and probation.
A 22-year-old Mitchell man, Casey James Girard, admitted to raping a 4-year-old boy. He pleaded guilty to one count of first-degree rape, a felony with a maximum penalty of life in prison and a $50,000 fine.
Girard admitted in court Tuesday to committing the crime while babysitting the child in early November at a residence in Mitchell.
In exchange for Girard's guilty plea, prosecutors agreed not to file additional charges and not to charge him as a habitual offender. They will recommend he serve no more than 40 years in prison.
Judge Tim Bjorkman ordered Girard to undergo a psychosexual evaluation. Bjorkman also ordered a presentence investigation and scheduled sentencing for April.
Another Mitchell man, Daniel William Forcier, 27, pleaded guilty to fourth-degree rape for having what he said was consensual sex with a 14-year-old girl at a residence in Mitchell. He faces a maximum penalty of 15 years in prison and a $30,000 fine.
Bjorkman ordered a psychosexual evaluation, a presentence investigation and scheduled sentencing for April.
Forcier has been convicted of similar crimes in the past, including a conviction for indecency with a child and sexual contact in 2004 in Texas, according to court documents. He is already a registered sex offender.
In May, Forcier was sentenced to 60 days in jail for failing to register as a sex offender after moving to Mitchell several months earlier.
Richard Linneman, who pleaded guilty to fourth-degree rape in December, received a suspended five-year prison term Tuesday. He was ordered to serve 90 days in jail and put on probation for five years.
Linneman admitted at an earlier hearing to having what he called consensual sex in early October with a 14-year-old female victim in a camper in Mount Vernon, but the girl was not of consenting age.
Linneman was ordered to serve his jail time in segments, starting with 30 days immediately, with credit for three days served, 30 days starting Jan. 1, 2015, and 30 days starting Jan. 1, 2016.
Linneman was ordered to have no contact with the victim or her family. He was also ordered to pay restitution for any counseling the victim may require, and to obtain counseling for himself.
