Pierre teen accused in killing back in court
PIERRE (AP) — Lawyers for a Pierre teen accused of killing a classmate are resuming their argument that he should be tried as a juvenile.
KCCR-AM reports that a motions hearing is scheduled Thursday in the case of 17-year-old Braiden McCahren.
He pleaded not guilty to first-degree murder in the December 2012 shooting death of 16-year-old Dalton Williams.
Prosecutors say McCahren deliberately pointed a loaded gun at a third juvenile and fired but hit Williams instead.
The defense says the shooting was an accident.
The judge ruled in September that McCahren should be tried as an adult. The state Supreme Court overturned that and said the issue should be reconsidered but without the testimony of a psychologist.
McCahren was released from jail last month to the custody of his grandparents in Vermillion.
