David Muth, 41, of Mitchell, is accused of trying to purchase methamphetamine in a Mitchell parking lot.

A South Dakota Division of Criminal Investigation agent arrested Muth last week for attempting to buy a controlled substance, a felony which carries a maximum penalty upon conviction of five years in prison and a $10,000 fine.


Muth has been associated with his family's company, Muth Electric, in the past and was listed as a vice president as recently as several years ago. It is unclear whether he is still with the company, because Muth Electric officials did not immediately return calls Monday from The Daily Republic.

According to court documents, Muth made arrangements June 2 to purchase meth. On Wednesday, he allegedly met the dealer in a parking lot at 1800 N. Main St. in Mitchell, and exchanged money for approximately 4 grams of meth. Law enforcement officials arrested him there.

He was released on a personal recognizance bond Friday.

It is unclear from court documents how law enforcement knew Muth would be in the parking lot. The DCI will not provide further details at this time because the investigation is ongoing, said Sara Rabern, spokeswoman for the state Attorney General's Office. She declined to comment when asked if the dealer was a confidential informant, undercover law enforcement officer or criminal suspect.
