Mitchell man pleads guilty to selling pot
A Mitchell man pleaded guilty Tuesday to distributing 1 ounce or less of marijuana.
Brian Volk, 38, was accused of selling marijuana to a person at a Mitchell gas station in December. As part of a plea agreement, the state agreed to drop a misdemeanor possession charge, recommend a suspended two-year prison sentence, and a cap of 60 days in jail.
The distribution charge carries a maximum penalty of two years in prison, a $4,000 fine or both.
Judge Tim Bjorkman ordered a presentence investigation and scheduled sentencing for November.
