Mitchell man gets jail time for stealing gas from DOT
A Mitchell man who stole gasoline from the South Dakota Department of Transportation over a five-year period will serve 30 days in jail.
Gary Lee Trabing, 60, was arrested in May and pleaded guilty in August to stealing more than $1,000 worth of gas from the DOT. He said he started taking gas in 2008.
Judge Tim Bjorkman ordered Trabing pay $8,954.20 in restitution, a $5,000 fine, $104 in court costs and serve 18 months of probation. Bjorkman granted him five days of work release for his first 10 days of jail time to work on the family farm.
He paid the restitution, fine and costs Tuesday so Bjorkman also granted that Trabing may come back in six months and ask for a suspended imposition of sentence, which would give him the chance to wipe the felony conviction from his record.
Trabing will serve his jail term with 10 days immediately, 10 days in June 2014, and 10 days in December 2014.
